1. The Promoter is Nissan Motor (GB) Limited of The Rivers Office Park, Denham Way, Maple Cross, Rickmansworth, Hertfordshire WD3 9YS (‘Promoter’). 2. The Draw is only open to UK residents aged 18 or over, excluding employees of the Promoter and its group companies, and any agencies, advisors, franchisees, suppliers of the Promoter, any persons assisting in the Draw, any syndicate or collection of persons acting in concert; any person entering via an agent; any person using the services of an entity carrying on the business of entering prize draws and/or prize promotions; and any such entity itself. 3. Incomplete or illegible entries, bulk entries, entries from third parties and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. Proof of posting shall not constitute proof of receipt. The Promoter accepts no responsibility for entries lost, delayed or damaged. 4. No purchase is necessary. Only one entry per household. 5. To enter the Draw, participants must attend a participating dealer to collect an entry form and either accurately and fully a) complete the entry form and post it in the official entry box at the participating dealer; or b) complete the entry form and post it to New Nissan Micra Launch Prize Draw Promotion, Wyman Dillon Ltd, Silverhill, Rudgeway, Bristol BS35 3NS (‘Promotion Address’) after 6 January 2011 and before 23.59 on 13 January 2011 (‘Closing Date’). 6. First Prize: There will be five winners. Each winner and their chosen companion will win a UK City break to a choice of one of the following locations: York, Bath, Cambridge, Oxford or Edinburgh. 7. The First Prize is valid for travel until the end of 2011 excluding Christmas, New Year, Easter and bank holidays. Prizes are subject to availability at the time of booking. Hotel accommodation is based on two people sharing a double/twin room. Travel insurance is not included. Edinburgh prize consists of return train travel from the winner’s home town to Edinburgh, two nights’ accommodation at the Balmoral Hotel 5*, breakfast daily, 6-course Tasting Menu dinner at the Michelin starred Number One restaurant, top tickets to see a show of the winner’s choice at an Edinburgh theatre. York prize consists of return train travel from the winner’s home town to York, two nights’ accommodation at the Hotel du Vin York 4*, breakfast daily, 3-course dinner with wine at the highly acclaimed Melton’s restaurant, top tickets to see a show of the winner’s choice at a York theatre. Bath prize consists of return train travel from the winner’s home town to Bath, two nights’ accommodation at the Royal Crescent 5*, breakfast daily, 3-course a la carte dinner at The Dower House restaurant at the Royal Crescent. Cambridge prize consists of return train travel from the winner’s home town to Cambridge, two nights’ accommodation at the Hotel du Vin Cambridge 4*, breakfast daily, dinner with wine at the Hotel du Vin Bistro on one evening. Oxford city break consists of return train travel from the winner’s home town to Oxford, overnight accommodation at the Malmaison Oxford 4*, breakfast, 5-course tasting menu at Raymond Blanc’s restaurant at Le Manoir Aux Quat’Saisons, £100 wine allowance to accompany the meal, taxi transfers to/from the hotel/restaurant. 8. The winners agree if requested to participate in unpaid, reasonable publicity relating to or in connection with this Draw. 9. No cash or other prize alternatives are available. The Promoter, its agents and/or distributors reserve the right to substitute the Prize (or any part of it) for a prize or prizes of equivalent or greater monetary value if this is necessary for reasons beyond their control without prior notification. Unless agreed in writing by the Promoter the prizes can only be awarded to the winners in person. Once booked by the winners all dates and names are final and cannot be changed. The Promoter will not be liable for tickets or prizes that do not reach the winners for reasons beyond the Promoter’s reasonable control. 10. On 25 January 2010 (‘Draw Date’) winners will be randomly selected from all complete, correct and eligible entries received before the Closing Date, in the presence of an independent observer. The Promoter’s decision shall be final and binding and no correspondence will be entered into. 11. The selected winner of the Draw will be notified by post, phone or email within 28 days of the Draw Date (‘Notification Date’). If the Prize is declined or unclaimed by the winner or if the winner cannot be contacted from the details supplied on their entry form within 10 working days of the Notification Date, a replacement winner may be drawn at the Promoter’s discretion and will be notified by the Promoter by email or phone. To claim the Prize the winner may be required to supply proof of age.12. All participants and winner agree not to discredit, denigrate or bring into disrepute the Promoter, its products or services and confirm that they have no reason to believe that their participation in this Draw will have such an effect. 13. Except in the case of death or personal injury arising from its negligence, or in respect of fraud, and so far as is permitted by law, the Promoter and its associated companies and agents and distributors exclude responsibility and all liabilities for any loss, damage, cost and expense, whether direct or indirect, howsoever caused in connection with the Draw or the Prizes. 14. The Promoter reserves the right to extend, amend or withdraw the Draw or any part of it without prior notice or compensation where this is due to circumstances beyond its control. 15. If the Promoter has reasonable grounds for believing that a participant has contravened any of these terms and conditions, the Promoter reserves the right to disqualify that participant and to select an alternative participant at random from the remaining complete, correct and eligible entries received before the Closing Date. 16. The first name and county of the winner can be obtained by sending a stamped SAE after the Closing Date to the Promotion Address. 17. The Promoter will use the winner’s, and each participant’s, personal details for the purpose of administering this Draw. 18. The Promoter and its business partners may also use the personal details provided by participants to contact participants about its products and services. By entering this Draw, participants hereby indicate their agreement to this use (unless participants have indicated otherwise). 19. By entering this Draw, all participants will be deemed to have read, understood and agreed to these terms and conditions and any other requirements set out in the accompanying promotional material. 20. These terms and conditions and any dispute or claim arising out of or in connection with them shall be governed by or construed in accordance with English law and subject to the exclusive jurisdiction of the English courts.
